Terms and Conditions

Please read these Terms carefully before using Hank. They set out the rules for how you use the Service, your account, payments, and our mutual responsibilities.

1. About Hank

Hank is an AI-powered home ownership companion application provided by Hank ('we,' 'us,' or 'our'). Hank is accessible via our mobile application on iOS and Android and through our web application at app.hankhome.io (collectively, the Service).

The Service helps homeowners manage home maintenance, track appliances and systems, store home-related documents, interact with an AI assistant for home-related questions, and maintain a record of home improvement projects and completed maintenance tasks.

2. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms and Conditions ('Terms') and our Privacy Policy, which is incorporated into these Terms by reference.

If you are using the Service on behalf of a business, organization, or other entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

3. Your Account

3.1 Registration

To use most features of the Service you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@hankhome.io if you become aware of any unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account due to your failure to protect your credentials.

3.3 One account per person

You may not create more than one personal account. You may add multiple home profiles within a single account.

4. Subscription Plans and Payments

4.1 Free tier

Hank offers a free tier that provides access to a basic home profile, a limited number of AI chat messages per month, and an upcoming task list.

4.2 Hank Pro subscription

Hank Pro is a paid subscription plan available on a monthly basis ($7.99/month) or an annual basis ($59.99/year). Hank Pro includes all features of the Service.

4.3 Billing and renewal

Subscriptions are billed in advance on a recurring basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal.

4.4 Payment processing

All payments are processed by Stripe, Inc. We do not store your full payment card information. Your use of payment features is also subject to Stripe's terms of service. By providing payment information, you authorize Stripe to charge your payment method in accordance with these Terms.

4.5 Cancellation

You may cancel your subscription at any time through the My Home tab in the app or through the Stripe customer portal. Cancellation takes effect at the end of the current billing period. You will retain access to Hank Pro features until the end of the period you have paid for. We do not provide prorated refunds for partial subscription periods.

4.6 Price changes

We may change subscription prices at any time. We will provide at least 30 days' advance notice of any price increase to your registered email address. Your continued use of Hank Pro after the price change takes effect constitutes your acceptance of the new price.

4.7 Taxes

Prices listed do not include applicable taxes. You are responsible for paying any taxes applicable to your purchase, including sales tax, use tax, or VAT, where required by applicable law.

5. The AI Assistant and Limitations

5.1 Nature of AI-generated content

Hank's chat assistant and maintenance recommendations are powered by artificial intelligence, including large language models provided by Anthropic, PBC. The information Hank provides is for general informational and organizational purposes only. It is not professional advice of any kind — including but not limited to structural engineering advice, licensed contractor advice, legal advice, insurance advice, or financial advice.

5.2 No guarantee of accuracy

AI-generated responses may be incomplete, outdated, or incorrect. We make no warranty that Hank's advice is accurate, complete, or appropriate for your specific situation. Always verify important home maintenance decisions with a licensed professional.

5.3 Inspection report parsing

Hank's inspection report parsing feature uses AI to extract and interpret information from home inspection PDF documents. The extracted information is provided as a convenience and may not capture all items in the report, may misclassify items by severity, or may miss context that a licensed inspector would consider important. The original inspection report remains the authoritative document. We strongly recommend reviewing the original report in full with a licensed professional.

5.4 No contractor or professional referrals

Hank does not employ, endorse, vet, or guarantee the quality of any contractor, tradesperson, or professional. Any contractor information stored within the app is entered by you and is not verified by us. We are not responsible for the work, conduct, or qualifications of any individual or company you engage.

6. Home Data and Content You Provide

6.1 Your content

You retain ownership of all data and content you enter into the Service, including home profiles, maintenance records, uploaded documents, photos, project details, and contractor information ('Your Content').

6.2 License to us

By using the Service, you grant Hank a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely as necessary to provide the Service to you. We do not claim ownership of Your Content.

6.3 Accuracy of your data

The quality of Hank's recommendations depends directly on the accuracy of the home data you provide. You are responsible for ensuring that your home profile, appliance records, and other data entries are accurate and up to date. We are not liable for recommendations or outputs based on inaccurate information you have provided.

6.4 Document storage

Documents you upload to the Service — including inspection reports, warranties, invoices, and receipts — are stored using Supabase's secure cloud infrastructure. While we take reasonable measures to protect your documents, we strongly recommend maintaining independent copies of any important documents. We are not responsible for data loss resulting from circumstances beyond our reasonable control.

6.5 Prohibited content

You may not upload or transmit content that is unlawful, harmful, defamatory, obscene, or that infringes the intellectual property rights of any third party. We reserve the right to remove any content that violates these Terms.

7. Intellectual Property

7.1 Our intellectual property

The Service, including its design, software, text, graphics, brand elements, the Hank name and mascot, and all related intellectual property, is owned by Hank and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or brand elements without our prior written consent.

7.2 Feedback

If you provide suggestions, ideas, or feedback about the Service ('Feedback'), you grant us a perpetual, irrevocable, royalty-free license to use that Feedback in any manner without restriction or compensation to you.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Service, our systems, or the accounts of other users
  • Use automated tools, bots, or scrapers to access or collect data from the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or commercially exploit the Service or any data obtained through it
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload malicious code, viruses, or any software designed to damage or gain unauthorized access to systems
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

9. Third-Party Services

The Service integrates with and relies on third-party services including Supabase (database and authentication), Anthropic (AI language model), Stripe (payment processing), and weather data providers. Your use of these services is also subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of these third-party services.

Links or references to third-party websites or services are provided for your convenience only. We do not endorse and are not responsible for the content, privacy practices, or terms of any third-party site or service.

10. Disclaimers

THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

HOME MAINTENANCE ADVICE PROVIDED THROUGH THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL INSPECTION, ASSESSMENT, OR ADVICE BY A LICENSED CONTRACTOR, ENGINEER, OR OTHER QUALIFIED PROFESSIONAL.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HANK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, PROPERTY DAMAGE, OR PERSONAL INJURY — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hank and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

13.1 Termination by you

You may close your account at any time by selecting 'Delete Account Data' in the app or by contacting us at support@hankhome.io. Upon account deletion, your personal data will be deleted in accordance with our Privacy Policy.

13.2 Termination by us

We may suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately.

13.3 Effect of termination

Upon termination, provisions of these Terms that by their nature should survive will survive, including intellectual property provisions, disclaimers, limitation of liability, indemnification, and dispute resolution.

14. Dispute Resolution

14.1 Informal resolution

Before filing any formal legal claim, you agree to contact us at legal@hankhome.io to describe the dispute and seek an informal resolution. We will make reasonable efforts to resolve disputes informally within 30 days.

14.2 Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

14.3 Arbitration

Any dispute that cannot be resolved informally shall be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You agree that any arbitration will be conducted on an individual basis and not as a class action, collective action, or representative proceeding. TO THE EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

14.4 Exceptions

Notwithstanding the arbitration provision, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm, and either party may bring individual claims in small claims court if the claim qualifies.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email to your registered address and by displaying a notice in the app at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service before they take effect.

16. General Provisions

16.1 Entire agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Hank regarding the Service and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
